Query regarding importing RC transmitter of 2.4/5.8 Ghz unlicenced spectrum

Hello

Had a query can I comfortably import RC transmitter 2.4/5.8 Ghz unlicensed spectrum from Chinese website without any issue, as I guess they already have been brought in India by bulk agents here or do I need any licence for same

Well, I am not 100% sure about current situation.
But I bought a flysky fsi6 Tx from banggood last year in november and it came directly to my house, no custom hassles, no duties, no nothing, straight forward simple delivery.
I chose my shipping method as India Direct Mail, and it took around 15days to deliver and I got it cheaper than what they sell in India for.

If you wish to order in bulk then you will definetly need a import license.
And It might not be that easy as import of transmitter and such goods are banned for what I have heard.

But the problem is Bangood has stopped "India Direct Mail" service for anything related to RC.

 if you're importing any transmitter, receive or transceiver then it is banned in India. However the 2.4 GHz systems along with 5.8 GHz systems are being exempted from this condition. The WPC website has a database of type approved equipment which can be imported to India. If you're trying to import a transmitter, you should better check if its already type approved by WPC or not. If it is not approved then you need to apply for approval but that route is costly as the approval fee is high. However IF it is approved then you can just show that evidence to get your transceiver out of customs.

I mean 2.4/5.8 Ghz is unlicensed so can I import any brand transmitter or is there any list of brands/models with wpc and I can import same without issues

Yup,
Any Brands are allowed for 2.4 or 5.8 Ghz Transmitters.
Also do check the WPC website for other transmitters which may be allowed.

But I have a query as ETA is needed for delicenced spectrum so is there any list of items/model with wpc that has been accepted and given eta so same can be referred while importing without any trouble?

Sub: Requirement of type approval from WPC for import of wireless
transmitters, wireless receiver, remote controlled toy
helicopters, toy aeroplanes for hobby/recreational/aero
modelling purpose and other wireless equipment operating in
the frequency band of 2.4 GHz to 2.4835 GHz – reg.

Attention is invited of all trade members & individual importers importing or receiving
gifts at Postal Appraising Section, Foreign Post Office, Mumbai, from abroad consisting of
wireless transmitters, wireless receivers, remote controlled toy helicopters & toy aeroplanes
for hobby/recreational/aero-modelling purposes and other wireless equipments in the
frequency band of 2.4 GHz to 2.4835 GHz. to Rule 3 of Üse of Low Power Equipment in the
frequency band 2.4 GHz to 2.4835 GHz (Exemption from Licensing Requirement) Rules,
2005", which specifies:
"Notwithstanding anything contained in any law for the time being in force, no licence
shall be required by any person to establish, maintain, work, possess or deal in any
wireless equipment, on non-interference, non-protection and shared (non-exclusive)
basis, in the frequency band 2.4 GHz with the transmitter power, Effective Radiated
Power and height of antenna as specified in the Table below, namely:-

2. Further as per Rule 6 of the above Rules:
(1) The wireless equipment shall be type approved and designed and constructed in
such manner that the bandwidth of emission and other parameters shall conform to the
limits specified in the Table referred to in rule 3.
(2) The application for obtaining equipment type approval shall be made to the Central
Government in such form as may be specified by that Government in this behalf".

3. Kind attention is also invited to the frequently asked questions available on the website
www.wpc.dot.gov.in, FAQ No.5, which is as follows:
Qn: Ïf a particular product is exempted from license, still I need to notify Wireless Planning
and Co-ordination Wing (WPC) about it before use? Can I import the same without need
of any license?
Ans: If the produce is not Type Approved, then it is required to inform WPC and obtain Type
Approval from WPC. Import License is required from WPC to import any equipment,
other than Broadcasting Receiver and TVRO System".
4. Accordingly, even if as per manufacturer's catalogue/certificate/clarification, the imported
subject wireless equipment meets all the conditions of Rule 3 even then as per Rule 6
type approval of the said equipment is required to be obtained from WPC. Each & every
wireless equipment operating in frequency band of 2.4GHz to 2.4835 GHz be it
transmitter, receiver, toy helicopter, toy aeroplane etc. whether meeting the requirements
of Rule 3 or otherwise are required to be type approved by the WPC before being
imported into India. If the product is not already type approved then after goods arrive in
India and before customs clearance, importers are required to inform WPC and obtain
type approval from them.
5. Accordingly, all the importers and trade members are hereby informed that henceforth no
import clearance of any subject mentioned wireless equipment will be allowed unless it is
type approved by the WPC. This is equally applicable to individual importers importing
one or two pieces for personal use i.e. hobby/recreation/aero-modelling purposes as well
as traders in commercial quantity.
6. For procedure regarding obtaining type approval, please refer to Memorandum dated
08.02.2007 of Ministry of Communications & Information Technology and the format for
application for equipment type approval, both available on website

Thanks a lot.I still have a query as I simply want to know or guide me say I want to import few number of any transmitter brand x of model 123 the same has been already imported legally by some agent but do I still need to apply for approval as it's already been imported before or is there any list where I can cross check to see items if it has  been granted approval

Great friend,where is this list or how can I be updated of new additions by WPC in this matter

Search for "ETA list WPC"
You'll get it.
But it doesn't seem to have any R/C equipment at all. Only wifi modems and laptops like ancient Lenovo thinkpads.
The list is very old and not updated.
If anyone else is aware of a newer version, do tell.

Whatever your own interpretation of the rules, the Excise & Customs Dept. has only one. Thus there is a 98% chance your Radio Set will be confiscated

If you like to play such odds, go ahead. Else buy locally, or get it hand-carried by a friend/relative in their baggage. That has a 75% success rate

Friend nice to know ur view, be assured any govt dept has some rulebook, guidelines  it minimizes hassle and same applies here , this only pertains a smooth delivery and less of hassle

This is a futile discussion

Apart from WPC Rules, Drones & Components, and Aeromodels and their parts thereof are BANNED. Radio Controller falls under this.

You have been a member since May 2017, perhaps you have not read all the horror stories of confiscation.

In any case, if you want to import for yourself, go ahead. But do not advocate the same to any other member - you will be doing him a gross disservice

First of all member profile and also the past history faced by members doesn't all determine the actual content as I have received query response from dept in past on certain topic as again repeating I follow rules and guidelines which dept too follows and we as fellow forum member never advocate as this is just a discussion forum not any official statement and I hope it's clear to you very much
