Hello annichatre and nairitb,

I have ordered a mobile phone from japan worth Indian Rs.3800 (Declared Rs.2205 on parcel and as a GIFT)

and is held by customs ahmedabad, asking me for following documents,

1.Purchase Invoice/Commercial invoice,

2. Transactions details/payment details,

3. PAN card copy

4. Requested me to read Customs notification S.O.No.1056(E) dated 31.12.1993 ( Which states import of electronic items for personal use below   Rs.2000 only is exempted from duty)

Kindly suggest what should i do. If i provide them with purchase invoice and payment details, they will not consider as gift. And what if i tell them it is genuine gift and i dont have invoice,payment and send other documents.

Please reply at earliest guys. Need your valuable suggestions.

Sir it can be a gift only if it is coming from another friend or person. If you bought it from a company how is it a gift ? I suggest you show them the invoice and say it was incorrectly labeled by sender.

To inform you guys, Consumer Electronic goods worth more than Rs.2000 (including shipping) is restricted to import by Airmail or post. The same is liable for penalty. I just came to know this rule recently.

Import of other item is allowed as GIFT for Rs.10000 ( though customs site shows Rs.5000) Excluding shipping charges. That means if your parcel value is 9900 and  your shipping is 1000, It still qualifies for duty free import provided it is a GIFT. and electronic goods above 2000 can be orderd by courier.

Hi,

If your parcel was sent by REGISTERED AIRMAIL, then you can be 99% sure that you won't be charged any duty. Atleast I have never heard of an incident where someone was charged duty when the parcel was sent by REGISTERED AIRMAIL. By my own experience, duty is charged on parcels sent by AIR PARCEL and EMS, apart from private courier (DHL, FedEx etc.).

However, if you receive a parcel with Highly charged customs duty and/or penalty, you can do one of the following:

1. Do not receive the parcel and tell the post office to send back parcel for re-evaluation by customs dept. You will need to send an invoice (obtained from the seller) and payment proof (credit card statement or bank statement, depending on payment method). Re-evaluation process and subsequent delivery to you can take upto 2 months, depending on what type of customs officer evaluates your parcel (lazy or honest) 

2. You can receive the parcel and pay the duty amount. And then apply for partial refund from the Central Board of Excise and Customs (CBEC). Refund form available from CBEC website. Again, same evaluation process process as first option.

For both options, you may or may not get a refund, depending on what the customs officer decides. If you do not get a refund, you can write to the next higher authority.

I hope I have answered your query. Feel free to revert back for further clarification. Will do my best to explain whatever I know.

Since 27/11/2014 there is no update, I had seen in this forum above for duration to change status from "Send item to domestic location (Inb)" to "Receive item at office of exchange (Inb)" is only few days. In my case it is already it is 14 days. I didn't receive any notice also.

You better register a grievance at http://pgportal.gov.in/. Select Central Govt > Department of Posts and fill in the necessary details. When filling "Grievance Description", be as polite as you can and do not mention why you need that parcel, whats inside the parcel and so on. Mention necessary details ONLY.

I have done it 3-4 times till now whenever my parcel was not delivered 15 days after status "Send item to domestic location". It works and I get my parcel after that.

Hey Najju First Of all welcome To the Forum, Now lets come to your Parcel well as it says its in Kolkota Foreign LACO if you see Its In the Sorting Office Actually Now they are sending it to The Nearest Customs That is Ahemdabad as you live in Vadodara and nearest customs in Ahemdabad. As I can see its a cap it should be cleared soon and should reach you soon.

But how much time it will take to reach from Kolkata to ahemadabad it is already 5 days and the status is same

Aman. Please don't call me "Sir".  We are like brothers. And I am too young in this forum. 

By the way, Customs clearance is generally done in the same city where the parcel is received in a country, ie the first point of entry. Its Kolkata in this case. But this is the first time I have seen that a parcel is sent more than 2000kms for it to be assessed by Customs dept!!! 

It takes more than a week for a parcel to go from Kolkata to Guwahati!! So you can make a guess for Ahmedabad. And its sent by Indian Railways (international airmail items)!!! The parcel should be delivered within next 15-20 working days, provided customs office does not take too long to assess the parcel.

Please have patience with the postal and Customs. It may take a long time for the customs to clear. It usually takes 2 weeks for Kolkata Customs to clear.  It takes another week to reach.

The Custom that is nearest to your place will be clearing the parcel and not the 1st receiving place in India. In my case where I stay near Kolkata, my parcel is custom cleared by Kolkata. The first landing port can be Chennai, Kochi, Delhi but the Custom is always cleared by Kolkata Customs.

First Of all ok Nairit as you say.
@ najju :- don't worry man it will update soon as its cap its not prohibited to order a cap so it wont stuck in customs and maybe it would have reached ahemdabad customs and they don't update actually. Sometimes you can get a surprise by receiving your parcel soon without getting update in Tracking status.

@ GN :- First Of All welcome To The Forum Gn.
Now, As you ordered a Mobile From Aliesexpress I think you should receive it soon as its been a month and maybe it would have cleared. Second thing you should have contacted Customs by email I am not trying to scare but if you have then its okay for now. But I really think as its been a month you should receive it soon.

I purchased few motors ,esc and other things from ebay international but i dint get any shipping detais as in tracking code but the shipment is marked as shipped wht should i do when I messaged the seller i got this msg as reply

Day 5 status :

Parcel at IPS web tracking : No change, same as old status " Send item to domestic location (Inb) Air CHENNAI FOREIGN POST OFFICE"
Grievance : No change, same as old status "Received by DDG PG"

But the miracle thing, amazing event happen that My parcel delivered at home by postman this morning.

So I can say IPS web tracking don't have the latest developments of parcel movement.

@nairitp, @aman and @this wonderful forum : Thanks all again. I had almost lost hope on my parcel, only this forum and you people build the confidence on me that at anycase I won't miss my parcel.

Patience is the best medicine for parcels from abroad. I will close my grievance today.
