Friends need  :help: Am trying to get West Bengal Form50A online thru http://www.wbcomtax.gov.in/welcome.asp but each time its rejected. Dont know Y ? Have a package in Uttar Pradesh and have to get into west bengal but courier wants Form50A. The item is for personal use not for sale. I have the item invoice and AWB details, can any1  :help:.....Thanks

Dear Mod, thanks for the reply. if you go to that site wbcomtax.gov.in and click on demat waybill for unregistered user I'm filling out all details and since its for personal use I belong to B category so no Entry Tax applicable, jst need someone who did this online before. So I can know my mistake and rectify and submit again. This dept. doesnt even say why the application is rejected.

Your status states you are at Afganisthan, and importing in Kolkata :headscratch:

Are your Java Updated ? NIC uses JRE. However if you are not using Digital Sign. it may not be crucial.
If you are in Kolkata, Go to Pranjali, near Hestings crossing. NIC even e-tender helpdesk is their.
But you cannot go from Afgan... ;D :giggle:

I too have question related to Form 50A generation. I have 3 clear questions:

1. Do the personal goods (Category B) attract any Entry Tax? If yes, can we pay it online?

2. I am able to generate a DematWayBILL Form Application successfully but the site does not send any SMS for the WAYBILLKEY no. How to get it? Is there any time limit after which the application is approved and I can get that SMS key? or the SMS is sent only to West Bengal Mobile Numbers?

3. Any toll free number for help related to Waybill form generation. I tried calling the numbers listed in the site but no one picks them up.

An early reply will be highly appreciated on my direct mail i.e. saitherapycentre @ gmail dot com

I just saw your query to West Bengal Waybill Form 50A. Find the details below of my experience below which will surely help you out.

I purchased a 10" Boston Mattress from Noida online through ebay.in. Before the dispatch the seller asked me to get the Form 50A, that time I was a novice like you on Form 50A. I tried searching on internet but no luck, then a friend of mine asked me to go online into their site. Since it was for my personal use I did exactly like what you are doing going for Category B but 3 days it was rejected. Tried calling them from Afghanistan sending email but no use. I asked my brother who stays 70 Kms outside Kolkata to visit the Tax Office at Beliaghata ( Sealdah ) Kolkata and see why it's getting rejected. When he went there he was told that we have to pay TAX + Entry Tax to obtain this form 50A, to our surprise he was also told after paying the tax to bank, upload the documents and fill out the webpage and then visit them, pay them Rs. 300/- as bribe then then will issue the Waybill. We had no choice as I already paid for the mattress Rs. 20,000 Approx. Now here is another thing, Entry Tax is 1 % of the invoice amount, and State Tax is I believe 13% or so I forgot, but keep in mind the percentage is worked on the total invoice amount including the the sales tax you paid in the invoice. I was really upset, if I knew this before, I would have never made this purchase as of the tax I paid was around Rs.4000/-. Or else I would have asked the Seller to reduce the total amount on the invoice. That was my horrible experience and will never buy anything online if I have to obtain the form 50A.

Try with Gati Courier, last I purchased a Double bed from Rajasthan worth Rs, 25,000/- the seller booked through Gati and Gati did not require the form 50A and it was delivered without hassle. Shipping through railway is much better, ask Gati that you require shipment to go through Rail, and not road. :banghead: :bow:

Same status is with us. We are trying calling to WB Office and sending them emails but of no use. We can pay entry tax also as it is only 1% but we are not ready to pay any other local taxes which may be there as it is meant for personal use only. Dont know what to do. Looking to hire any one in West Bengal who can get it generated for me and charge a few bucks for their service.

Buddy if you dont wana pay the 13% tax then forget it. I was helpless and had to pay the tax as I already paid the seller for the product.

Hi ,

We are trying to send our orders from UP to West bengal to our customers and we need form 50a for the same ! How do we obtain this form ? we are not registered dealers with WB and the customer is also not a registered dealer. We are an ecommerce website. Please help as our courier partner fedex refuses to take any shipments there . there is no option on the government website also , if there is then please let me know.

Hi,

I am an electronics hobbyist, although not into RC and not an engineer, have worked on few PIC microcontroller projects. My other hobbies include railroad audio recording and photography. I really thought this info should be out in public domain.

I was importing a Sound Devices Mix Pre-D (mic preamp/mixer) worth Rs. 62,175 from the U.S. since domestic dealers at Mumbai/Delhi were quoting too high a price. I thought if I import it from U.S. through Fedex, I can bypass Form50. Alas, how wrong I was! After it cleared Delhi customs with 25% duty, Fedex Kolkata people called me to get a Form50 within 4 business days! They also emailed me pdfs of Proforma invoice, AirWayBill, Customs Invoice and Bill of Entry. I was shocked because for my earlier imports they never asked for it.

So paid 1% advance entry tax of Rs. 622 through GRIPS portal, installed JRE on my PC, generated XML file, and applied online as an unregistered dealer category B, and was hoping for the best. After 2 days, no SMS was sent, but an email came citing 'your application has been temporarily suspended, reason: to pay additional tax/security worth Rs 14,818. You can contact Sr. Jt. Commissioner at Room no. 710, Central Section, 2nd Building.

So I went there with my father with all the documents. Luckily my father had some contact person there, who helped us break the bureaucratic ice a lot. When I told Sr. Jt. Commissioner how I had applied online, first he rebuked me for applying during Puja holidays. (Obviously he had little idea of an application queue) Then he said " These things can't be done online completely/Why haven't you contacted me before applying/How can I verify online if you are an individual or a dealer". He also asked details about the product. Finally he told my dad to go to Sealdah court (besides station/Big Bazar) to get typed an 'Indemnity Bond' asking  for security exemption & stating that I'll indemnify the officer for any revenue loss. He gave as a format for the bond. He also needed address proof, pan card and voter ID card of the consignee.

Since we started from Midnapur at early morning and lunch time was approaching, I lost my temper and demanded an explanation why this wasn't mentioned online, why I needed to pay more security when entry tax was already paid. I also flatly told the Sr. Jt. Commissioner that if you harass unregistered consumers like this, then it defeats the purpose of e-service and this is unacceptable in 2015. (My father later rebuked me for my rude behavior, but I felt it was honest and somebody had to say it)


However, he told this is the only official way he could waive the security under VAT act. Luckily we managed to get the job done with Rs. 250 within 40mins and return. His junior later told that generally these are not waived at all for invoice amounts above 10K, only waived this time because of my dad's acquaintance/ dad's being ex govt. servant. He approved the application at 12.55pm and told NIC will email me the waybill key by the evening.

We went back home after thanking our 'connection' official. NIC sent the email at 5.40pm. Again, no SMS was sent. When I tried to generate the waybill in FF it produced error messages but on Chrome worked flawlessly! Ha, so much for a Waybill! Hope this helps.


TLDR:
(i) Every inbound shipment attracts entry tax at 1%
(ii) Unregistered person may need to pay addl. security (not VAT) if Sr. Jt. Commissioner is not convinced that you are not a reseller.
    Burden of proof rests upon you and your 'contact'.
(iii) Better to inform them in advance and get the indemnity bond prepared.
(iv) E-challan through GRIPS portal can totally bypass corrupt clerks / long queues
(v) SMS system is apparently broken, check your inbox instead.

I have several queries on the requirement of waybill in West Bengal.

Earlier many online dealers on eBay used to insist upon producing Form 50A or else they used to express their inability to send goods to WB. Since 2012 some changes have probably been made and most dealers do not insist upon that.

1. As end users of an item do we need to produce waybills?
2. Is there a value limit of goods above which waybill is required?
3. Can end users generate waybills through the online link at http://wbcomtax.nic.in/e-Services/e_waybill.htm or http://wbcomtax.nic.in/e-Services/e_unreg_demat_waybill.htm ?
4. Since most online sellers do not insist upon waybills any longer, has there been a change in the law?

Hi Santanu,

Although I'm not qualified to answer those, I can guess:

1. Yes, and consignee has to generate it and supply it to the courier company.

2. I don't know, but I was fined Rs. 4000 for importing a 4"x2"x2" neodymium magnet worth Rs. 8000 from Chandigarh as an end user. (I was unlucky, my goods got seized.) CST was already paid, but dealer and me were unaware about the WB Waybill requirements at that time. That was an website/email exchange based purchase made 2 years ago. The courier was Trackon, their support was a nightmare.

3. That was the goal theoretically, but as you can see, they will suspend your application and make you visit them and take your interview! Plus the Sr. Jt. Commissioner was not very pleased when I told I applied online, who knows why. Maybe he hates automation/ Maybe since paper waybills often involve bribing at the last stage, and everyone gets a cut? So maybe that's why he harassed us by asking for indemnity bond which seems totally unnecessary otherwise? But these are nothing but pure speculation. Once you get the waybill key, you can generate/reprint your e-waybill online.

4. I have read the acts, which are silent/ambiguous about unregistered persons, giving officers sufficient discretionary power. Many lesser known couriers accepting consignment without waybill are just taking chances. If your goods get seized by chance, you have to pay heavy penalty to release it. I don't know about Ebay, but one officer told that you're not required to get waybill for Flipkart/Amazon shipments, as they have their separate system.

That's a matter of concern. I have purchased so many things online. Even today a Panasonic Air Purifier worth 9K purchased through eBay was delivered to me. Never faced any problem. So I thought all such problems regarding waybill have been resolved. Assuming eBay, Flipkart etc. have arrangements, what about others? I have purchased quadcopters and components from LHSs directly. Not faced any problem so far. How is the end user supposed to know all these things unless the couriers inform us?

I checked out Blue Dart's document on state wise regulations. West Bengal has a 1% Entry tax on e-tail shipments irrespective of any value and Form 50A is required for unregistered dealers or individuals which can be done online at http://egov.wbcomtax.gov.in/DematWaybillUnregistered/ as per instructions in http://wbcomtax.gov.in/e-Services/User_Manual_Demat_Waybill_Unreg_dealer.pdf

As per Page 9 of the last document, individuals bringing goods for their own consumption are not liable to pay tax. They have to generate a waybill nevertheless. So I am confused. Maybe I'd have to look into the rules. :headscratch:

That line from page 9 is wrong and misleading, I told Commissioner that it should be corrected ASAP. Unfortunately you can challenge an official only by citing acts/rules but not by citing some demat waybill manual (probably written by some IT guy).

Tip: Since the acts and rules are large documents, look for 6 keywords: unregistered / casual / personal / consumption / security / exempt.

In particular, you may want to read Page 6, Section 10 of Entry Tax Act (which deals with entry tax) and Page 103, Section 105 of VAT Rule (which deals with additional security). Also Page 37, Section 15, last line of VAT Act rudely says "Provided that the burden of proving that any purchase effected by a casual dealer is not liable to tax shall be on such casual dealer". Although I could not get from the definition at Page 16 if I can call myself a casual dealer.

If you are still awake after reading all these, you can look for keyword 'penalty' and see how much power is given to the commissioners!

But I am not a casual dealer ! I am a casual buyer. I don't sell it again. Or does the burden of proof of that too lie on me?

Now, if this is true then what about the hundreds of items that I have purchased so far and did not have to pay any tax (VAT or Entry Tax) at all? if I am liable to tax (and I am not even aware of it) then there must be thousands of people like me who are liable to the same tax and the state is losing crores of revenue. What is the point of having some rule and not enforcing it? Or do they enforce the rules randomly and some unfortunate guy who gets caught has to pay the fine and penalty and the majority escape without paying? What is the point of having such rules?

Online payment is a good step but something has to be done to make people aware of the rules and to streamline the rule as well. Picking up people randomly won't fill the state's coffers. It would only enrich some unscrupulous taxmen.

for that you have to have information of consignee's details along with user id adn password or way bill key number....so that you can login into the form to fill out form with additional information..

I thought this thread now needs a GST update. As CBEC and GST council struggle to rollout pan-India e-waybill due to lack of IT infrastructure, it has been decided that e-waybill will start from 1-1-18 in a staggered manner, and will be fully operational from 1-4-18. (Source: Newspaper)

Meanwhile, the evil WB Govt (and also UP Govt), by virtue of WBGST Ordinance 2017 has decided to continue with their old e-waybill system (basically the same Form 50A for unregistered dealers). The only concessions given are
(i) One doesn't need e-waybill if consignment value is less than Rs 50,000 (and probably Rs 5,000 for UP)
(ii) No entry tax is applicable on any consignment.

The latest Amendment (in the line of CBEC's draft e waybill rules) talked about generating EWB-01/02 from common portal, and this can be done by transporters on behalf of unregistered persons. The document is now confusing as pan-India ewaybill which was supposed to come this month has been deferred. I'm not sure whether the latest amendment has come into force (probably not). Hopefully this mess will get sorted out by FY18.
