What if I use 433Mhz for telemetry?

Hi guys,
confused with this small thing- I am planning to buy Arduflyer 2.5 with GPS and 433Mhz telemetry..
But I read somewhere 433 is not legal. Is it?

If I use then they will catch me? :O only for small telemetry?

And is 915Mhz legal? I will use that instead..

Here the mobile phones operate on 900MHz. That is not legal. Not sure about 433MHz though.. If you operate a small wattage Tx, I don't think you would have any problems legally. If you are going the 900MHz way, be prepared for a lot of RF interference.
