I imported few RTF planes from china four yaers back, and the customs detained the parcel saying that there is potential to create serious security risk. but i never gaveup fought with the customs, finally i got the order from commissioner appeals and released the parcel after two years. a copy of the order is attached, i hope this will be of great help to the fellow flyiers planning to import RTF/ ARF planes.

You fought and persisted. However one thing which glaringly stands out from the order is that, initially you had declared these models as simulated/3D remorte controlled jet aeroplanes.
I beleive using the same terms as in the HS Code (i.e. reduced sized scale models) in the reply to call memo would have potentialy obviated the issue. I from personal experience can tell you that , every time I get a call memo this is what I mention.
BPut then your case very clearly points out that being on the right track and being persistent would yeild results.

i never declared myself that the models as simulated/3d remote controlled jet planes, it's the customs guys did that

This is a little scary to me, I have just placed an order for a CB100 micro heli. Please advise if I would face this hiccup? If so, please advise how to get out of it....

Just a word of caution,
These letters though good to know, do not constitute an authority for release of your parcels which may have been detained. Each case would be unique and the customs authorities have the powers to deal with it accordingly. In case you go for an appeal this document along with the case law cited in the document would be of help to prove legitimacy of your claim.
In case there are questions regaridng your parcel, the best would be take the line of stand as in these documents and try and convince the responsible people that your claim is genuine. Showing this document would not work in most cases and at worst may even aggravate the situation.
I agree with Capt. The best bet would be to act naive and convince them that you are genuine and dont have any other motive.
Govt officials feel they know everything and hate to be told what needs to be done.

Even I would agree with Capt Flyingboxcar. Though there is NO clause in the Customs Exims to ban import of Airplanes, such a document would hardly help. The complete whims of the officer in charge would govern how it goes. IT is not court justice where judgement from previous case are used as guideline.
Nevertheless its a great act of courage form your side. What the hell customs were doing with the package for 2 years!! AFAIK they auction/destroy confisticated items every year to free the holdup area!

First point - If you classify them as Airplanes then this is a controlled item and you need various other permissions. As I said earlier, you need to speak the same language as in HS Code - i.e. reduced sized scale models
Second point - A ruling from High court can only be cited in that particular state, Supreme Court's ruling is applicable over all states.
Third point - If the item in question is under dispute/appeal they can not dispose it off whatsoever till resolution/disposal of dispute
You dont need to buy anything extra if you have Microsoft Office 2010. All office documents can save in PDF format.
Santosh, If you do not have Office 2010 then can you please send me the high res JPG files to convert in PDF?

OffTopic, but we know of companies who use 350 OpenOffice installations, and 4 licensed MS Office copies ;)
MS Office is only used by personal secretaries and office clerks to convert complicated documents to earlier versions of MS Office so that OpenOffice can open them without losing any formatting :giggle:
