Reason for confiscation.Did you import any prohibited item by Indian customs.with out any notification they would not have confiscated.

Even if you did not provide proper documents nor deny to pay duty Indian customs has rights to confiscate only after 6 month
But in your case how come 3 month something fishy

Hello verybody yes mbt actually if you have imported any probhited product then they are going to seize it and they will ask documents for releasing the parcels that you have to get from Exercise department india.

Hi,
Everyone...

I did not imported Any prohibited items.

I just import HK500 KIT...which has not any Electronic item in the Parcel.

Customs FPO says "This is a Toy heli in Dismantle condition."

and for import of toy it require some certificate.

So anyone have idea about this ??

what can i do...

i already provided all documents to him.

How many have you imported?

You mean they say Toy then why they need document or certificate?

Have customs retained any of your previous item imported?

If they got you name in data then its going to be tough time because customs has watch list people import for commercial purpose but declare it as personal use and under value it.

This is my First Heli Kit.
As per import of toys Notification he asking about certificate.
But this is not TOY...this is model heli kit.

This is my first item which is Detain by FPO.

Unfortunately "SCALE MODEL" items comes under EXIM code 9503 which is related to Toys category. So, the requirements for the toys is applicable to Scale model items.

(b) ISO 8124 (Parts I-III) or
(c) IS 9873 [Parts I-III] or
(d) EN 71;
and
(ii) A Certificate of Conformance from the manufacturer that representative sample of the toys being imported have been tested by an independent laboratory which is accredited under International Laboratory Accreditation Cooperation (ILAC) Mutual Recognition Arrangement (MRA) and found to meet the specifications indicated in (i) above (to know more on ILAC MRA visit the website: http://www.ilac.org/). The certificate would also link the toys in the consignment to the period of manufacture indicated in the Certificate of Conformity.

Digging further on the codes (my job)
All mentioned Standards ASTM F963 or ISO 8124 (Parts I-III) or IS 9873 [Parts I-III] or EN 71;  says
"It applies to toys for children, "toy" being any product or material designed or intended, whether or not exclusively, for use in play by children of less than 14 years." :banghead: and hence this certificate is not required for our items.

Then just check for the files in particular heli model from hobbyking which will be below specification i.e near by reviews.Never send unwanted document to customs.

There is vast meaning from retained and confiscation.

Retained holding shipment for a reason.

Confiscation means seized we can't get the item ever.

I know this ,

This all certificate is only require for such toys.
I already told them and provide related documents.

But superintendent intentionally mis-Classifieds to under toys.
and ask certificates.

i already told them there is no require certificate.

Still i am finding solution....And thinking to meet chief commissioner.

but please advise and if any one have proof than please send to us..so i can get my parcel..

Hi Akcopter. I see that your problem hasn't been solved since many days. First of all, remember one thing. Try not to go to Customs Office in person. Always try to communicate with them in writing (letters).

As I get it, you ordered a heli which is a model and cannot be flown.

Send them a RTI application asking for the relevant sections under which they are asking for a NOC from WPC "for a foam/model heli which does not have a Tx-Rx attached to it and which cannot be flown." Ask for a copy of the Act/Bill of which the sections pertain to. It'll cost you Rs 10 IPO and and speed post charges. See what reply you get.

I emailed them and told them that the parcel only contains thermocol parts, and very matter of factly asked them whether thermocol is banned in India. also asked them to email me the appropriate documents stating that WPC decides who can import thermocol .

These custom officers are like sheeps. They just blindly follow the rules as one sheep follows the other behind the other sheep. They dont use their brains especially in this RC items. They act like they know every thing about this RC items, but they dont know any thing. They only know the word "WPC Type approval" and put the shipment in hold, whenever they see a shipment with the name of Aeroplane, helicopter. I think an individual going for a wpc type approval is just like hell. They also know that this is impossible. If you ask them, how to get WPC approval, they say blah blah blah, which is very difficult to follow. All these type of RC toys are perfectly allowed with no restrictions in USA and other developed countries.

they are miss-classifieds under TOY and ask some certificate.

Hi I bought a 2ch micro rc tank and a micro soldering kit worth a Rs.1100  from hobbyking but I paid 600 as I used my points.
The customs are asking to pay me 200 as duty. The package was marked as gift.
Last time when my item which was 2500 was charge 41% they said if it was below 2k then it's free of charge and if it's a gift item then it's also free of charge under 10k .  
what to do?  >:(

Yes I did....

I sound a bit like a hypocrite...but all I want is for my parcel to be cleared...If I can somehow get them to believe that I don't require an NOC for the Plane at the same time have them not care about the actual Rx present separately in the order then I win!! But that seems a bit far-fetched... I hope there are people who understand my situation here !!   :'( :'(

Buy it but make sure you use fedex as a shipping option...nothing else ...add a small lipo so that fedex shows up as a usable shipping option

what if a gift item get stuck in customs which is below 10k? should we have to pay even if it should be free of charge?

This is outright bullying...if one is so naive as to believe that these so called officials create problems just because they have a poor understanding of the law..then that individual would be mistaken.... all that these people want, is to extract money...and I am sure if you met someone who is actually working within the public appraisal's section at the customs...you would realize their level of know-how about the law...if you observe the show cause notice which you received, then you would observe that it is a printed copy of the same notice which they send to anyone and everyone they think has a suspicious item in their consignment....and the signature is not that of the deputy superintendent of customs...he is too hung up in other serious work, he wont be signing random show cause notices...I observed mine and in the place designated for his signature all you could find is someone has signed "For"...and that's all...this is a clear sign of someone trying to extract some dough out of you, just because your package is heavy(which implies that it is costly) and that you would do anything to get it cleared....we need a some sort of an organization which can speak terms with these guys on our behalf...if the formation of such an organization requires some funds I am sure there are many people rcindia and elsewhere who will oblige and do their bit to ensure safety for their beloved hobby from thugs who think of us as pushovers   >:(

That's it !! i should Have used the word thermocol instead of foam....That would have done it :hatsoff: :hatsoff:
